"critical thinking and the rule of law"? Is this some right-wing parody of a left-wing nut site?
How about: "'She probably meant well' says Bryan Cuningham, giving a generous reading to Federal Judge Anna Diggs-Taylor's decision to 'the lone judge in American history to order a president to halt in wartime a foreign-intelligence-collection program that has undoubtedly saved lives.'
"stunningly amateurish" or "I wouldn't accept this utterly unsupported, constitutionally and logically bankrupt collection of musings from a first-year law student, much less a new lawyer at my firm."
and, "Amateur hour? Judge Taylor, a law professor, has been on the bench since 1979. She is decidedly not an amateur. So, how to explain her first-year failing-grade opinion? Regrettably, the only plausible explanation is that she wanted the result she wanted and was willing to ignore and misread vast portions of constitutional law to get there, gambling the lives and security of her fellow Americans in the bargain."
Many of those who oppose the Terrorist Surveillance Program recognize that Judge Taylor's decision does not help their cause and is worthless ("unhelpful") in addressing the serious legal and constutional issues presented by it and other aspects of the War on Terror.
But there is a bright side:
"As Judge Taylor's new favorite justice, Robert Jackson himself, warned, the courts should not 'convert the constitutional Bill of Rights into a suicide pact.' I will put my daughters to bed tonight confident that the Court of Appeals and our Supreme Court will not allow Judge Taylor's giant step in that direction to stand."

Dear Honorable Judge Taylor,
As an American, I am not willing to forgo any of my civil rights or freedoms guaranteed under the Constitution, Bill of Rights, and the laws of this county. I am angry the Bush administration has abused its power, taken advantage of the trust we granted him after 9/11, and has violated our laws. Thank you for standing up to the administration by demonstrating no one, including the President is above the law.

Too many people have allowed themselves to be intimidated because Karl Rove and his attack dogs in the right wing echo chamber might call them names or even make death threats against them, but that is not how this country got started and survived until today. In my darker moments I often feel that the USA is slipping into a place I don't want to be even near. I presently am an ex-patriated Canadian who would like to return to his native land at some point in the future, and I'm heartened people like Judge Taylor are making that decision easier for me. Dear Judge Taylor: I applaud and thank you for your legal opinion and ruling on GWB's warrantless illegal wiretapping. Somebody has to hold him legally accountable and responsible for the crime he has committed. He and his administration should not be above the laws that all other citizens of our country are required to obey.
It seems the current White House administration does not understand that it's not okay to wiretap American citizens without a warrant. Most Americans support the effort to combat terrorism through wiretapping, but it should be done legally, with a warrant.
To me, this administration and especially George W. Bush, seems like a serial killer that cannot be found, so he keeps on escalating the number and methods of breaking our laws so that he can be stopped. Thank you for stopping the enabling of a lawless man. Hopefully, your ruling will hold, even in the appeals process.

I support your ruling against the NSA's wiretaps. Some of my co-workers have told me that organizations that they volunteer for were wiretapped. One co-workers named Jill was volunteering for an animal rights group in New Orleans when an FBI agent came to the office and asked if he could search the premises. They were smart enough to ask for a warrant, which he did not have. The information that they used against the group came from the wiretaps. What would an animal rights group have to hide? I've been in the courts and tried unfairly when I tried to Help a American/Vietnamese frien who got tricked by two White Collar attorney criminals. She lost everything. Mr. Chertoff was in charge of White Collar Crime Investigations in 2001/2 etc. All I received was QUIT threats and much grief.

The founders added the Bill of Rights to the Constitution to protect our freedoms, even during times of threat and even when the thoughts expressed are unpopular. These rights aren't needed to protect popular ideas during safe times. To paraphrase Benjamin Franklin, those who would give up their freedom for security deserve neither.
The FISA law gives plenty of room to legally spy on those who represent a threat. Since the Bush administration refuses to obtain warrants before spying, I can only conclude that they are spying for political purposes.

Well done. It is no suprise to anyone following these issues that the legal defences used by the Bush Administration for breaking the law were specious and transparently false. Thus, the first judge who refused their "state secrets" dismissal applications (the only defence they have) ruled against the administration.
I think it's very funny that the Justice Department lawyers declined to refute the ACLU's case in a substantive way. Thank you for having the courage to stand up to the megalomaniac in the White House. I support your ruling in the (so-called) NSA Warrantless Wiretapping Program case all the way. It's about time someone with authority had the will to tell them, "This is wrong!" And whatever you do, don't let anything they say about you bother you. You know they're just upset because you wouldn't let them have their way. And you were right to tell them that if the law doesn't do what you need it to do, you change the law. You don't just ignore it and complain that it wasn't good enough! I just wish someone in the Bush Justice Dept got passing grades in law school. I never had any training in the law and even I could tell this law was unconstitutional. What's their problem?

Anyone who knows what legal analysis and legal argument look like -- anyone who knows the requisites of legal reasoning -- must look on the handiwork of Judge Anna Diggs Taylor in the NSA case in amazement. It is a pathetic piece of work. If it had been submitted by a student in my second year legal writing class at the University of St. Thomas Law School, it would have earned a failing grade.
On the issue of the legality of warrantless interception of enemy communications, for example, it is entirely conclusory. It does not address precedent. It assumes its conclusion, essentially framing the issue as whether the president can break the law. It simply asserts that the NSA eavesdropping program is "obviously in violation of the Fourth Amendment" -- apparently because it is warrantless. (Wrong.) She sagely observes that the "President of the United States is himself created by that same Constitution" -- you know, the one with the Fourth Amendment that she apparently thinks requires warrants in all cases.
Judge Taylor is like the big bad wolf in the fairly tale. She huffs and she puffs. I think she's facing the brick house that can't be blown down -- she at least can't blow it down -- but the end of this unedifying fairy tale has yet to be written by a higher and presumably more competent authority.

We just don't know what we have..our Constition and Bill of Rights...such a comprehensive and democraticly well thought out way to live with fairness and acknowledgement as a part of society---together--a blueprint to work, think and be, a person living on this earth with respect and dignity. Maybe we are learning how important and personal our Constitution is now that the king has no clothes and has somehow passed 805 proclamations...(I wanna know what they are and what their effect will be)???And where are all the other Judges and people paying attention to this corruption of our Constitution? Just wanted to thank you Judge Taylor for your courage and patriotism. I'm sure you were fully aware when you made your ruling that you would feel the full heat of the right-wing machine for not being a loyalist and for going against the unitary executive, but I hope you don't ever regret your decision. Just know that there are millions of Americans who truely appreciate your defense of the U.S. Constitution and the rights of all of its citizens! Thank you for speaking out against this anti-American administration.

Mr. HERLONG. Mr. Speaker, Mrs. Patricia Nordman of De Land, Fla., is an ardent and articulate opponent of communism, and until recently published the De Land Courier, which she dedicated to the purpose of alerting the public to the dangers of communism in America.
